CONDITIONS FOR USE

  • Social Tools only use the user information for the designed operation of the promotions. Social Tools Will never use registered user information for other purposes.
  • Social Tools will never be responsible for the prizes, products, or services that are offered to your users in the promotions.
  • Social Tools will never participate in a sweepstakes or offer a platform, online or offline, for the election of winners in the promotions.
  • Social Tools reserves the right to unpublish and eliminate any promotion at any time without prior warning the administrator of the promotion.
  • Social Tools will not refund the amount of any promotion once it has been paid for.
  • Social Tools The administrator of the promotion is the administrator of the Facebook page for which the promotion was created and used Social Tools to create and manage the promotion.
  • The administrator of the promotion is responsible for maintaining the standards of promotions on Facebook.
  • The administrator of the promotion is responsible for the content of the promotion.
  • The administrator of the promotion is responsible for all of the information inserted by and associated with the users who enter the promotion.
  • The administrator must indicate the conditions for use of the promotion that will collect the user information.
  • The administrator is responsible for selecting and notifying the winners and supplying the prizes, products, or services that are offerred in the promotion.

1. GENERAL CONDITIONS TO ENGAGE IN THE ACTIVATION OF PROMOTIONS AND CONTESTS USING APPS SOCIAL TOOLS

1.2. Read this document carefully. Here you will find the conditions that define the use of the activation of promotions and contests through an application SOCIAL TOOLS , the rights and obligations of both parties, information on the buying procedure and the conditions for use of the application in Facebook, among other questions.

1.3. We inform you that these General Conditions act in accordance with the established legislation in the field.


2. ACCEPTANCE AND VALIDATION OF THE GENERAL CONDITIONS

2.1. These General Conditions are obligatory for both parties. THE CLIENT will remain bound to each and every one of these General Conditions without reserve in order to use an application SOCIAL TOOLS , being your obligation and responsibility to read them prior.

2.2. Throughout the course of your order, prior to authorizing payment, the CLIENT must accept the General Conditions. If you do not agree with said conditions, do not proceed with the process, as said conditions will be applied in all cases.

2.3. This contract will bind the client and remain active for the duration of the promotion's activity. All regardless of the responsibilities the CLIENT may incur in the use of the application.


3. OUR PRODUCT: THE APPS OF SOCIAL TOOLS FOR FACEBOOK.

3. By activating a promotion or contest via an appliction SOCIAL TOOLS the CLIENT only aquires a license or right to temporary use of said application, with which he/she may create and manage promotions and contests from his/her Facebook page. THE CLIENT does not receive any property rights over the application or over the content provided with said application, belonging in its entirety and full command to SOCIAL TOOLS

3. Each promotion created with any of the apps SOCIAL TOOLS is linked to only one Facebook page.


4. ACTIVATION OF THE PROMOTION

The promotion or contest will only be activated once the CLIENT has paid the price that corresponds to the license of the selected use. Upon verification of the payment of said price the chosen application will become active and your promotion will publish immediately.


5. RIGHT TO WITHDRAWAL, CANCELLATION OF THE LICENSE AND RESOLUTION OF THE CONTRACT.

5.1 ABSENCE OF RIGHT TO WITHDRAWAL: The licenses for use of the apps SOCIAL TOOLS is based on computer files supplied electronically, susceptible to immediate character reproduction. As such, according to current laws, once the application is contracted, the CLIENT can not discontinue the purchase and request a refund of the amount paid. In any case, remember you have one (1) free license to use that you can try out and activate a promotion using our SOCIAL TOOLS BASIC application

5.2 CANCELLATION OF THE LICENSE AND RESOLUTION OF THE CONTRACT FOR THE CLIENT: THE CLIENT may resolve the present license contract and deactivate the contracted application at any time. To do so, he/she must send a cancellation request to the email address payment@socialtools.me. SOCIAL TOOLS will under no circumstances reimburse paid amounts to the CLIENT.

5.3 CANCELLATION OF THE LICENSE AND RESOLUTION OF THE CONTRACT FOR SOCIAL TOOLS :

  • A) SOCIAL TOOLS may resolve the present license contract and cancel and deactivate the promotion without any forwarning or prior request to the CLIENT, if it receives a notification of improper use from Facebook or a competent authority, the CLIENT in such case having no rights to demand from SOCIAL TOOLS a refund of the amount paid nor any compensation for damages or to third parties, profits, or any other cause.

  • B) SOCIAL TOOLS may also resolve the present license contract and cancel and deactivate the application without any forwarning or prior request to the CLIENT, if Facebook changes its promotion policiy and/or apps in which use of the application contracted by the CLIENT becomes unfeasible, whether for legal, technical, or any other motives not in the control of SOCIAL TOOLS , the CLIENT in this case not having any rights to demand from SOCIAL TOOLS the refund of the amount paid nor compensation for damages or third parties, profits, or any other cause.

5.4 Termination of the present contract for any cause will imply the finalization of any obligations regarding maintenance, exercise, or installation that fall under SOCIAL TOOLS in relation to the application.


6. INTELLECTUAL AND INDUSTRIAL PROPERTY.

THE CLIENT recognizes and expressly consents to all copyrights, registered trademarks, and other intellectual or industry property rights regarding the application or the content provided as part of the application, at all times to SOCIAL TOOLS or whomever granted to SOCIAL TOOLS license to use. THE CLIENT can not use said material without express authorization of SOCIAL TOOLS.


7. LIABILITIES AND GUARANTEES.

7.1 SOCIAL TOOLS agrees:

  • A) To make sure your apps are strictly in accordance with the policies and promotions for apps of Facebook.

  • B) To not participate in the sweeptakes or intervene or influence in any way the design of the promotion or the election of the participants or winners.

7.2 THE CLIENT recognizes, consents, and assumes that:

  • A) The application is a standard software that has not been designed to fulfill the singular specifiactions of the CLIENT.

  • B) It is not possible to execute the application in a way that will be error-free under all circumstances, as it may experience errors, including deactivation, as a result of modifications or technical incidents in the design platform of Facebook.


8. RESPONSIBILITIES.

8.1 SOCIAL TOOLS declines any responsibility derived from information or content that it does not directly manage.

8.2 In particular, SOCIAL TOOLS retains all responsibility in regards to the content that the CLIENT incorporates, divulges, designs, or manages through the apps of SOCIAL TOOLS, such as use by the CLIENT or third parties who make the content or the application SOCIAL TOOLS. By way of example and without limitation, SOCIAL TOOLS will in no situation be responsible for:

  • A) the quality or conformity of the products, services, or prizes offered by the CLIENT through the application;

  • B) the compliance of the offers and conditions of the promotion;

  • C) the legality and/or truthfulness of the publicity, information, conditions, and any content published by the CLIENT or for third parties, whether directly or through links;

  • D) the infraction of third-party rights or any other infractions derived from what the CLIENT incorporates in the application or derived from the use of the same;

  • E) the infraction of third-party rights or any other infractions derived from the conduct, actions, or content of the CLIENTS of the promotions/contests that the CLIENTS create and/or manage through a SOCIAL TOOLS application;

  • F) penal or administrative torts or any responsibility for infractions or illicit acts not derived from willful misconduct committed by SOCIAL TOOLS.

8.3 THE CLIENT assumes all responsibility that may derive from the information and content that incorporates the use of the application and of those derived by use of said application; of the compliance of the content of promotions and contests; and that the terms and conditions of the same comply with the promotion policies of Facebook according to the laws of the client's country and/or the territories affected by the promotions or contests.

8.4 SOCIAL TOOLS is relieved before the CLIENT and before the third parties of all responsibility for problems with the application derived from errors, malfunctions, or any technical incidents of Facebook or the application platform of Facebook.

8.5 SOCIAL TOOLS will not be responsible for interruption or functional problems with the apps derived from modifications or changes by Facebook in the software, platform, or the conditions and policies of the function of the social network and of the apps and promotions within.

8.6 SOCIAL TOOLS will not be responsible for interruption of or problems with how the application functions derived from excess of server resources, virus, malware, damage, or any other technical incident that is not directly related to SOCIAL TOOLS.

8.7 SOCIAL TOOLS will under no circumstances be responsible for a breach caused by force majeure or situations beyond its control.

8.8 SOCIAL TOOLS will under no circumstances be responsible for the adequacy or success of the application for achieving the ends as defined by the CLIENT, so that SOCIAL TOOLS will not be responsible for said ends or success independent of any notified end.


9. COMMUNICATION, SUPPORT, AND ASSISTENCE.

7.1 SOCIAL TOOLS places at the disposition of the CLIENT communication, support, and assistence services for the resolution of any doubt in regards to the application's function, via the email payment@socialtools.me


10. APPLICATION MODIFICATIONS.

SOCIAL TOOLS reserves the right to improve, substitute, or modify the application or the code of the application at any time, after being able to adapt the product to the changes in the application platform of Facebook, or to introduce improvements in the functionality of the product.
